Part of VAT for Banks and Financial Institutions in Saudi Arabia: The Complete Guide

Regime
Saudi VAT
Provision
Article 51(8)-(10)

In brief

Article 51(8)-(10) allows a supported application and approval by notification, for up to five years. A higher recovery percentage is not proof of accuracy or permission to adopt a method unilaterally.

An alternative VAT apportionment method is justified by a better measure of use. A low recovery percentage, a large difference from a competitor or an attractive financial result does not establish that the statutory default is inaccurate.

Articles 51(8)-(10) provide the application, decision and direction framework. The opportunity is relevant to any qualifying mixed business, including financial institutions; it is not a special concession reserved for banks. A useful application shows which costs are misrepresented, why the proposed driver measures their use more faithfully and how the calculation can be verified.

ProvisionWhat it providesPractical consequence
Article 51(8)Application for an alternative that more accurately reflects use of goods and servicesCompare the proposed method with the default, using evidence of consumption.
Article 51(9)Approval or rejection by notification; an approved period of no more than five years, renewable through a new applicationRead the actual notification for scope, period and conditions; do not assume every approval lasts five years.
Article 51(10)ZATCA may direct another method and its period where the default or approved method does not accurately reflect usePrior approval does not prevent a later direction.

These provisions do not establish a deemed approval because an application has been pending, a fixed response deadline or an automatic retrospective entitlement. Confirm the effective period in the notification. Do not rewrite past returns using a preferred method merely because the application has been submitted.

The controlling Arabic Article 51, PDF page 52 and the Input Tax Deduction Guideline, third version, May 2026, sections 13.1-13.3, pages 56-58 should be read together. The guideline’s English wording about a method that may or must be used is not a general licence to switch between methods during an approval period.

Correct the cost pools before comparing methods

Article 50 restrictions and non-economic use must be addressed first. Article 51(1)-(3) then separates costs directly attributable to taxable supplies, costs directly attributable to exempt supplies and eligible residual costs. Changing the residual method does not make a blocked cost deductible or turn an exclusively exempt cost into a shared overhead.

Suppose a lender has an outsourced collection service used only for exempt lending and a separate shared IT platform serving lending and taxable fees. A proposed driver for the platform does not automatically justify allocating the collection invoice to taxable activity as well. The business must demonstrate the use of each pool.

For the default fraction itself, verify supply classification and statutory exclusions before alleging distortion. An error in the numerator or denominator is a classification problem; it does not necessarily require a new approved method. See the Article 51 apportionment guide.

What ZATCA actually illustrates

Section 13.1, page 57, contains ZATCA’s table of possible methods and suitable circumstances. It is an official illustration of method design, not a worked numerical case or evidence that a particular taxpayer’s application has been approved.

Method in ZATCA’s tableCircumstance illustratedQuestion for the application
Transaction countTransactions consume similar inputs regardless of valueAre transactions comparable in complexity and resource use?
Input valuesSupply values distort relative input useCan the input attribution be reconciled without circular assumptions?
Employee full-time equivalentsEmployee-related inputs are significant and time can be tracked accuratelyDoes the count reflect actual time and the relevant cost pool?
Floor spaceRent and associated costs are a significant inputAre common areas and different premises uses treated consistently?
SectoralDistinct activities have separately measurable residual input VATAre sector boundaries and cross-sector shared costs supportable?

Read ZATCA’s complete table. The guidance requires a verifiable basis and expressly avoids promising approval for any listed method. It also leaves room for other supported methods.

Dariba’s analysis. A driver can be persuasive for one pool and weak for another. Floor space may explain premises costs while poorly reflecting central transaction-processing systems. A sectoral proposal should explain both its sector calculations and how central costs move into those sectors, without counting the same invoice twice.

Dariba illustration: compare the result without claiming approval

Assume a finance business has correctly classified qualifying taxable supplies of SAR 90 million and exempt supplies of SAR 600 million in the relevant default-method reference year, with no relevant exclusions or non-economic activity. Its fraction is 90/690, approximately 13.0435%.

After direct attribution and restrictions, eligible shared input VAT is SAR 20 million. Dariba assumes the following proposed drivers, supported for illustration by reliable operating data:

Eligible shared poolInput VATProposed taxable-use shareProposed deduction
ITSAR 9,000,00022%SAR 1,980,000
PremisesSAR 5,000,00025%SAR 1,250,000
Employee-related VAT-bearing servicesSAR 6,000,00018%SAR 1,080,000
TotalSAR 20,000,000Weighted result: 21.55%SAR 4,310,000

The unrounded default fraction gives approximately SAR 2,608,696, rather than an exact SAR 2.6 million. The proposed result is SAR 4.31 million. These are Dariba’s assumed figures, not ZATCA’s approval of a 21.55% recovery ratio.

The larger deduction creates a question, not its answer: why do processing, premises and employee data measure consumption more accurately? If transaction complexity or outsourcing changes, the same driver may cease to be representative. Test those changes before presenting the method as durable. Salaries themselves do not carry input VAT; the final pool contains VAT-bearing services associated with employees.

Prepare an application that can be checked

Section 13.2, page 58, directs requests to ZATCA’s online portal and calls for details of the method and its accuracy. The following are Dariba’s recommended supporting workings, not a prescribed eight-part form or a statutory three-year evidence requirement:

  • Describe the taxable person, activities and supply classifications, and reconcile the current default calculation to the underlying records.
  • Identify the affected costs, direct attribution already performed and the specific distortion requiring an alternative.
  • Explain formulas, sector boundaries, treatment of central costs, data sources and controls against duplication.
  • Compare results over a representative period and explain whether changes in business mix alter the conclusion. Use enough reliable history to test the proposal rather than assert a mandatory three-year minimum.
  • Propose the operating period, handling of provisional versus actual data, review triggers and renewal process.

For a VAT group, analyse the proposal for the taxable person as registered. Legal-entity boundaries do not automatically create valid sectors or permit separate unapproved methods.

Operate within the approval and prepare for expiry

Record the notification, approved scope, start and end dates, conditions and any subsequent direction. Do not infer an unrestricted right to revert to the default merely from the word may in an English explanation. Seek confirmation where the permission to change methods is unclear.

Article 51(7)‘s default-method year-end comparison should not simply be copied into every alternative without reading its terms. A proposal should explain how estimated and actual driver data will be reconciled, and the approved mechanism should be followed consistently.

Section 13.2 describes a fresh application at expiry or reversion to the default. Renewal is not automatic. Start preparation early enough to obtain a clear position before expiry; a recommendation to begin early is not a statutory one-year filing deadline.

The finance team’s decision is whether a verifiable measure better reflects use, and whether it can be maintained throughout the approved period. A method that produces a higher percentage today but cannot be reconstructed from records is not a defensible improvement.

Key takeaways

  1. Correct restrictions, non-economic use, direct attribution and the default fraction before alleging a need for an alternative.
  2. The method must more accurately reflect use and have a verifiable basis.
  3. ZATCA lists possible methods and suitable circumstances without promising approval for any of them.
  4. The scope, effective period and conditions come from the notification; there is no automatic five-year term or inferred retrospective permission.
  5. English wording about a method that may be used does not establish an unrestricted right to switch during approval.
  6. Recommended evidence, back-testing and early renewal preparation are not statutory three-year or one-year filing requirements.
