In brief

Test statutory deposits, return entitlement and recognised deferred tax assets, with ZATCA examples and the corresponding liability consequences.

Statutory deposits and deferred tax assets are separate Zakat deduction categories. Restricted access to cash is not alone sufficient for the deposit route, and an unrecognised tax loss is not automatically the same as a recognised deferred tax asset. The correct closing amount and any corresponding liability adjustment remain part of the calculation.

Establish the relevant general accounts-payer route

Current amended Arabic Zakat Implementing Regulations Article 26 identifies statutory deposits under Article 56 and the deferred tax asset as distinct deduction items. The actual payer and any special activity rules must be identified before using the general treatment.

ZATCA’s Guideline for Deduction Items from the Zakat Base, first edition July 2025, sections 3.6.3–3.6.4, explains the two categories. A general description involving regulatory deposits does not establish that every financing or insurance payer uses the same unrestricted rule.

Dariba recommends identifying the recognised balance, legal basis, payer route and year-end classification separately. A convenient restricted-assets ledger code does not determine which condition has been satisfied.

Prove the statutory deposit obligation and competent authority

Article 56 requires the payer to be obliged to place the deposit with the competent authority under the relevant laws. The guideline explains the category in the context of regulatory requirements and the depositor’s right to recover the amount.

An ordinary bank deposit, voluntary reserve, commercial security deposit or amount management elects not to spend is not automatically covered. Establish the actual legal requirement and authority rather than inferring eligibility from restricted liquidity.

Dariba recommends retaining the applicable requirement, placement terms, competent-authority evidence and the recognised closing balance. These records connect the restriction with the actual statutory route.

Test entitlement to a return rather than cash receipt alone

The controlling Article 56 condition concerns no entitlement to returns. A return accrued but not yet received should not be treated as absent merely because no cash reached the payer before year-end.

Official Deduction Items Guideline Example 39, section 3.6.3: the company is legally required to place SAR 15,233,562 with the competent authority and no returns are due to it. The guide permits the closing deposit deduction on those facts and requires the corresponding Article 25 correction because it is current.

Dariba analysis: retain the entitlement terms and actual balance together. Legal restriction and absence of return entitlement are independent conditions; satisfying one does not cure failure of the other.

Preserve ZATCA’s interest-bearing contrast

Official Example 40, section 3.6.3: changing the previous facts so that the company earns a 1% return means the deposit is not deductible under that route. The small rate does not create an exception to the condition.

That example concerns the return on the deposit, not a Zakat rate or a late-payment penalty. It does not decide the treatment of a different asset or payer under another express provision.

Dariba recommends resolving any unclear return entitlement before claiming the deduction. A change to the terms should be assessed on the actual applicable facts and period rather than treated as retrospectively removing an existing entitlement.

Identify who is legally entitled to any investment return

Official clarification: the Deduction Items Guideline, section 4.2, question 5, considers a regulator investing the deposit. It distinguishes returns belonging to the payer from returns allocated wholly to the regulatory authority, and permits the latter case subject to the other deduction conditions.

Read this with controlling Article 56(2), which requires that the payer has no entitlement to returns on the deposit. The investment activity of the regulator and the payer’s legal entitlement are different facts. A deposit does not automatically fail merely because the authority invests it; it does not automatically qualify because the payer has not received cash yet.

Dariba recommendation: retain the governing requirement and placement terms, including who owns each return and whether it is credited, accumulated or payable to the payer. Resolve unclear rights before claiming a deduction. The official 1% example remains a contrasting case in which the payer earns the return; this clarification does not create a small-return tolerance.

Identify an actual recognised deferred tax asset

Article 26(10) expressly identifies the deferred tax asset. The guideline’s section 3.6.4 discusses deductible temporary differences, unused tax losses and unused tax credits in that recognised-asset context.

A deferred tax asset is not interchangeable with an ordinary current-tax refund claim, an unrecognised loss schedule or cash prepaid to a tax authority. Establish the financial-statement recognition and value supporting the actual item.

Dariba analysis: the Zakat deduction does not create accounting recognition that otherwise lacks support. The financial-reporting assessment of recoverability, tax rates and required disclosures must be established under its applicable requirements.

Use the official closing-balance example

Official Deduction Items Guideline Example 41, section 3.6.4: the non-current deferred tax asset opens at SAR 3,109,590 and closes at SAR 2,356,695. The guide deducts SAR 2,356,695 under Article 26.

The example illustrates why a prior-year amount or gross historical tax-loss value is not the deduction simply because it appears in the reconciliation. The supported closing recognised balance supplies the amount on the example’s facts.

The SAR 752,895 movement between those balances is arithmetic, not a second deduction. Reconcile the accounting movement without double counting the opening asset and closing asset as separate Zakat claims.

Keep classification and corresponding liabilities consistent

The deposit example expressly requires the current-asset liability correction. Article 25 can also require a correction where another qualifying deducted asset is current. Use the actual classification and eligible inputs rather than imposing a correction merely because the asset relates to tax.

Deferred tax liabilities have their own Article 29 addition treatment. Do not invent a unilateral tax-schedule offset between different balances or ignore the approved financial-statement recognition and relevant statutory rules.

Dariba recommends reconciling the qualified asset deduction, revised liability categories, ratios and final cap. The gross deduction amount alone does not establish the net reduction in base or Zakat due.

Maintain an evidence schedule for each category

For deposits, retain the legal obligation, authority, terms, return entitlement and closing balance. For deferred tax, retain the recognised asset and movement, underlying support and relevant financial-statement disclosures.

The deductions overview and apportionment guide connect those items with the complete calculation. Other special payer regimes and other taxes require their own applicable analysis.

Dariba recommends stating the specific category, amount, conditions and unresolved point. That makes the analysis useful without implying all restricted cash or all future tax benefits automatically qualify.

Key takeaways

  1. A statutory deposit needs the legal obligation and competent authority.
  2. No return entitlement is separate from no cash receipt.
  3. The official interest-bearing contrast preserves the actual condition.
  4. Use the recognised closing deferred tax asset.
  5. A movement or unrecognised tax loss is not another asset deduction.
  6. Current-asset corrections and special payer routes still matter.
