In brief

Apply Article 81 to Saudi insurance deposits, policyholder surplus and reserve expenses, retaining the actual addition rules and following-year condition.

Apply the insurance provisions alongside the general Zakat framework

Article 81 of the Implementing Regulations for Zakat Collection, 1445H, sets out specific treatment for statutory deposits, policyholders’ insurance surplus and specified reserves. Those provisions affect different parts of the calculation. A balance-sheet addition should not be confused with an expense adjustment in arriving at adjusted profit.

This analysis uses the current Arabic regulation and ZATCA’s Guideline on Modification of the Activity Result, first version November 2024, section 6.2. The controlling Arabic text is particularly important because the English regulation contains inaccurate wording for parts of Article 81. The analysis concerns Zakat; any CIT portion of a mixed company’s position needs its separate rules.

A statutory deposit is deductible only within the stated exception

Article 81(1) identifies the statutory deposit with the Insurance Authority as a deductible item unless the taxpayer is legally enabled to invest it or it is invested for the taxpayer’s benefit. The Arabic provision does not identify a GOSI contribution or an ordinary savings account.

The two limbs matter. An insurer should not assume the deposit qualifies merely because it chose not to invest during the year if it was legally permitted to do so. Equally, examine whether an arrangement invests the deposit for its benefit even if another party holds or administers it.

Dariba recommendation: retain the statutory basis, deposit terms and evidence of restrictions and investment rights. Distinguish the required deposit from any additional voluntary balance. A restricted label in the accounts does not, by itself, establish the Article 81 condition.

Include the policyholders’ share of insurance surplus as specified

Article 81(2) identifies the policyholders’ share of insurance surplus as an addition to the insurance taxpayer’s Zakat base. The treatment should not be reversed solely because the amount is attributed to policyholders rather than shareholders in the accounting records.

Dariba recommendation: reconcile the surplus allocation, amounts distributed and the relevant balance supporting the return. Identify the actual item governed by the provision rather than treating every amount payable to a policyholder as insurance surplus.

This is a specific addition rule, not a general statement that every customer liability is equity or that all policyholder payments have identical Zakat treatment. The statutory description and the actual accounts must be connected.

The non-current unearned-premium reserve has a separate base treatment

Article 81(3) identifies the non-current unearned-premium reserve as an addition under Article 19. Its classification and the applicable Article 19 conditions need examination. Do not automatically add the entire insurance-contract liability merely because the financial statements present several components together.

Dariba analysis: an expense accepted in determining adjusted profit can still have a relevant closing liability for base purposes. These are separate questions. Treating acceptance of the expense as proof that the related balance cannot enter the base would overlook Article 81(3).

Retain a schedule identifying the reserve covered by the provision, its current and non-current components where relevant, and its connection to the reported balance. Explain how the financial-statement presentation supports the statutory classification.

Identify the two specified reserve expenses and their professional basis

Article 81(4) addresses the unearned-premium reserve and the reserve for outstanding risks during the Zakat year, determined according to the relevant professional principles. It treats them as accepted expenses for reaching adjusted net profit, subject to the provision’s return-to-base condition.

Section 6.2 of the activity-result guideline explains the connection with premiums covering risk periods and claims or outstanding obligations. The analysis must identify the actual reserve rather than extend the provision automatically to every management estimate, contingency or accounting provision.

Dariba recommendation: keep the professional calculation, supporting risk or claims information, approval evidence and reconciliation to the expense charged. An actuarial report is useful evidence of what was measured; it should be read with the actual statutory category and the timing condition, rather than treated as automatic acceptance of every amount.

Preserve the following-year condition in the Arabic provision

Article 81(4) states that the reserves are to be returned to the Zakat base in the following year. That timing requirement should not disappear from the analysis. The English activity-result guideline also discusses reversal when the reserve’s purpose ends, but its narrative should not silently replace the controlling provision’s stated following-year condition.

The official examples considered below involve creation in one year and full release in the next. They therefore support that factual pattern. They do not establish a general permission to defer the statutory treatment indefinitely whenever a reserve continues for several years.

Dariba recommendation: identify the creation year and the following-year tax treatment in a reserve roll-forward. Where a material reserve remains beyond that year, address the controlling requirement and the specific facts; obtain clarification if the intended treatment depends on a reading the examples do not resolve.

Read the official reserve examples with their actual sequence

Official example: section 6.2, Example 41, of the English November 2024 activity-result guideline describes an unearned-premium reserve charged in 2024, closed in 2025 and reflected in 2025 income. The guideline accepts the 2024 expense on those facts.

Official example: the same section’s Example 42 concerns an actuarially estimated outstanding-risk reserve created in 2024, unused during that year and fully closed to the income statement in 2025. It likewise accepts the expense within that stated sequence.

The examples establish neither an exemption for all technical reserves nor a conclusion that a book loss removes the need to calculate the Zakat base. Preserve the professional basis, identified reserve and following-year release assumptions when applying their reasoning.

Reconcile the expense, closing balance and subsequent release

Prepare a schedule showing opening reserves, the year’s charge, amounts used, releases and closing reserves. Then identify the separate adjustments to book profit and to the base under the relevant provisions. The schedule should explain whether a subsequent release is already included in accounting income and how the Zakat treatment has been implemented.

Dariba analysis: avoid a mechanical add-back that counts the same economic item twice, but do not use that concern to omit a specific statutory addition or the following-year requirement. A reconciled calculation is necessary to show why each adjustment is present.

Keep Zakat distinct from insurance withholding, insurance VAT and captive-insurance transfer pricing. Each examines different legal questions; an answer under one does not automatically determine the others.

Key takeaways

  1. The controlling Arabic text identifies the Insurance Authority deposit.
  2. Legal investment rights and investment for the taxpayer’s benefit matter.
  3. Policyholders’ insurance surplus has a specific addition rule.
  4. The non-current unearned-premium reserve needs separate base analysis.
  5. Accepted reserve expenses retain the following-year condition.
  6. Official examples support their stated creation-and-release sequence.
