Articles 67 and 69–70; financing asset bridge and investment conditions

In brief

Build the financing-payer asset bridge under Articles 69-70, including investments, mature financing, derivatives, repossessed property and the SAMA deposit.

Financing-activity Zakatable assets are the remainder after the specific Article 70 categories are removed from total assets under Article 69. The English translation can obscure the distinction between the remaining Zakatable assets and assets receiving the separate listed treatment. Use the controlling Arabic categories and their conditions.

Build the asset bridge under Articles 69–70

Current amended Arabic Zakat Implementing Regulations Article 69 calculates Zakatable assets as total assets less the non-Zakat and separately Zakat-treated assets identified in Article 70. Article 67 uses net audited closing values.

ZATCA’s Guideline for Zakat on Financing Activities, issue 1 September 2024, sections 3.2.5–3.2.7, explains the excluded categories and the remaining asset-ratio numerator.

Dariba recommends a complete asset bridge with each excluded balance assigned once to its actual provision. The translation’s repeated use of Zakat assets in an equation should not be read as subtracting the final numerator from itself.

Identify fixed assets and property acquired through enforcement

Article 70 includes the specified net fixed assets/equivalents under Articles 49–50 and real estate that passes to the financing payer through enforcement of a mortgage.

A security interest over property is not automatically the same as the property having passed to the payer through enforcement. The actual legal asset, recognised balance and provision must be established.

The guideline’s collateral FAQ also distinguishes shares acquired in place of a claim: their investment treatment must be considered rather than automatically assigning the real-estate category. Dariba recommends retaining the enforcement/transfer documents and actual recognition.

Preserve the investment-specific conditions

Article 70 identifies qualifying domestic equity interests, registered direct/indirect financing funds, other investment funds under Article 45 and foreign equity investments with separately paid Zakat under the relevant investment provisions.

Official Financing Activities Guideline Example 6, section 3.2.8: the foreign-investment exclusion is not used where the required investment Zakat has not been paid. The same example separately identifies its qualifying domestic-investment facts.

Dariba analysis: an investment heading, a non-current label or a general claim of avoiding double Zakat does not replace those conditions. The investment overview connects the detailed domestic, foreign and fund routes.

Assess financing receivables and debt instruments by the actual paragraph

Article 70(7) addresses the specified debts due to the financing payer, wholly or in relevant part after one year or more regardless of accounting classification, including the stated financing forms and debt-instrument investments.

Paragraphs (8)–(9) separately address the specified government instruments for which the State bears Zakat and the Article 55 issuer-capital route, preserving their relationship with the earlier paragraphs. Do not deduct the same instrument twice because it meets more than one description.

The guideline’s asset table contrasts the stated maturity facts. Dariba recommends keeping the actual instrument, balance and contractual due evidence; a product being called sukuk or Murabaha does not alone determine every paragraph’s application.

Distinguish positive derivatives and the SAMA statutory deposit

Article 70(10) identifies positive fair value of derivatives due after one year or more. The corresponding negative-value funding category has its own Article 68 treatment.

Article 70(11) specifically identifies the statutory deposit with the Saudi Central Bank. The guideline’s asset table distinguishes that item from other statutory deposits within the financing route; ordinary Article 56 should not simply be imported where Article 66 excludes it.

Dariba analysis: identify the actual authority and payer route rather than applying the general statutory-deposit guide indiscriminately to a financing payer.

Use the official asset bridge without treating it as final tax

Official Financing Activities Guideline Example 6, section 3.2.8: total assets SAR 227,955,858 less the example’s SAR 111,435,395 excluded assets gives SAR 116,520,463 remaining Zakatable assets.

That balance enters the ratio; it is not itself the entire base or tax due. The guideline explicitly states that the ratio result must still be tested against the financing limits.

Dariba recommends reproducing the category reconciliation and checking arithmetic from the supported figures. Do not copy an illustrative rounded percentage into a separate exact calculation without explaining the resulting difference.

Keep short-term, trading and unmet-condition assets in the actual remainder

The guideline’s sections 3.2.5–3.2.6 and asset table identify examples of remaining Zakatable assets: cash, relevant short-term receivables, trading intangibles and investments failing their particular separate-Zakat conditions.

These are not a universal list independent of the regulations. An accounting measurement category such as FVTPL or FVOCI does not by itself establish whether the relevant investment conditions have been met.

Dariba recommends testing the actual category and conditions first, then calculating the remainder. Do not make an asset disappear from both the excluded schedule and the numerator merely because its eligibility remains uncertain.

Reconcile the ratio and final limits

The financing-base guide connects the asset bridge with qualified funding, audited values and the applicable group route. The limits guide explains Articles 71–72.

Retain fixed-asset support, enforcement/transfer evidence, investment calculations/payment, maturity schedules, recognised derivative values and the exact regulatory deposit basis.

Dariba recommends a reviewable category-to-formula reconciliation with the remaining conditions identified. Excluding an asset under Article 70 does not guarantee a corresponding cash saving where a profit-based limit determines the final base.

Key takeaways

  1. Article 69 uses the actual listed exclusions to determine the remaining assets.
  2. Foreclosed property differs from merely holding security over property.
  3. Investment exclusions retain their particular conditions and payment requirements.
  4. Financing and debt instruments require their actual maturity/category tests.
  5. The SAMA statutory-deposit rule is specific to the financing branch.
  6. The asset remainder enters the ratio and remains subject to final profit limits.
